The Saga of the House


Tonight was supposed to be our last night in our rental home. The real estate agent was going to deliver our keys and we were going to drive over to the new house for a look around. After that we were planning to order Indian takeaway and opened a bottle of champagne to celebrate.

Unfortunately today did not go according to plan. On Friday somebody with a legal grievance against the vendor lodged a caveat against settlement of our new house. Our conveyancer only found out about the caveat this morning and settlement did not proceed.

We hope that the issues between the vendor and the caveat-lodger are resolved in the next day or two and we can move in before the weekend. We definitely hope that there aren't protracted legal issues.

In the meantime we are stuck with a house full of boxes and nowhere to go. We have had to cancel removalists, cleaners and others.

We are exceptionally thankful that a new tenant has not been found for this house. Otherwise we could be looking down the barrel of homelessness.

Who has ever heard of a house sale falling through because the vendor defaulted? I certainly hadn't. The conveyancer says this is the first time this has happened in her 15 year career.

This has not been a good March.

At least we can still have the Indian takeaway.

Okay, I'm a confused US'er. Is the vendor the person who currently owns the house or the mortgage company or the real estate person who represents the seller? And is the conveyancer your real estate agent?

At any rate, what a bummer! Just when you think everything is okay...

Stephanie, the vendor is the current home owner, the one who is selling.

That really sucks Kate. Did the vendor live in the house, or was it a rental property? If it was a rental, it right be the revenue office who have lodged the caveat, for unpaid land tax. If it is, it should be worked out fairly quickly. they'll arrange to take the tax from the settlement money.

Years ago we as the buyer had to delay settlement by a few days (problem with some lost paperwork), & we off course had to pay a penalty for the delay. Does the same happen in this case? Is there a penalty for the vendor, because their delay is costing you?

omgoodness, of all the things to happen, hope this is settled very very quickly, moving is stressful enough without this, glad you can still stay in the rental. Sending you best wishes, good luck.

Kate, my dad lodged a caveat on the sale of our family house after he left mum because he believed it was being sold for less than it was worth. (as he had been told by his real estate agent friend) The sale fell through, and the house eventually sold to the same people for a few thousand less than the original cost. One thing you could ask is if you can move into the house at a nominal lease, or that the rent you pay is deducted from the final sale price of the house?

Kate I'm speechless! I've been busy this week and hadn't checked my favourite blogs for a couple of days, so missed this when you posted (until now!).

I hope by today things are settled and you will be moving happily and that things are settled. I'll be praying for you. I wish there was something else I could do for you.
